Subject: Suggestions for amendment in Transfer/Placement/Deputation policy for officers in the cadre of Superintendent/inspectors posted to Gujarat Customs Zone, 2018-M/reg.
Kindly refer to your letter F. No. II/03-04/EStt/CCO/2020 dated 04.02.2020 regarding amendment in Transfer/Placement/Deputation policy for officers in the cadre of Superintendent/inspectors issued vide F.No. II/03-12/Estt/CCO/2017 dated 02.05.2018.
2. At the very outset, the association would like to thank your goodself for inviting suggestions from us. When the suggestions were sought, elections for the Executive Committee of the association had been declared and it was decided to make suggestions by the elected body only and the same was conveyed to your good office. Accordingly, the elected body after discussion and deliberation hereby proposes the following amendments in the existing Customs Policy for the Superintendent/Inspectors of the Gujarat Customs Zone. Our suggestions are aimed at exposure of Customstomaximum officers as well improved work culture in Customs with all possible facilitation measures.
3. The delay in submission of our suggestions are due to the process of elections of our association and then owing to the ill effects of Covid19 pandemics and thus the delay in submission of our suggestions may kindly be condoned and our following suggestions may kindly be considered positively.
Para 4(f): Sanctioned strength/working strength for the posts of Superintendent/Inspector in South Gujarat Customs is very less as compared to the number of officers of CGST & CE Vadodara Zone, which is feeder zone and thus to provide exposure to maximum officers Para 4(f) may be replaced with the following :
“f) The tenure of posting of officers to Gujarat Customs Zone will be three years. Period of tenure will be counted from Annual General Transfers, and not from the date of joining.”
However, amended Para 4(f) may be given effect to prospectively i.e. officers posted under existing policy may be allowed to complete their tenure as per the policy under which they had joined Customs.
Para 4(g) : Since the Senior most officers are being posted in Customs and thus promotion of Inspectors to Superintendents takes place mostly during tenure of an officer in Customs which results in non-availability of vacancies for the Superintendents. It is therefore requested that Para 4(g) may be replaced with the following :
“g) An Inspector, who has been promoted to the post of Superintendent in the first year of his posting in Customs shall be repatriated to CGST feeder zone. An Inspector, who has been promoted during the next year(s) shall be allowed to continue to work in Customs at the discretion of the Cadre Controlling Authority of his feeder zone on the basis of his willingness on in-situ basis till the forthcoming AGT in which he shall be repatriated to CGST Zone.”
Para 5(b): As of now, we have a good number of officers who have never worked in Customs. To maintain an equilibrium of experience as well as exposure, we suggest the following to be replaced in Para 5(b) :
“(b) Both the zone will prepare list of officers considering –‘(i) 50% of the officers in descending order based on their service tenure, who have never worked in Customs in combined cadre of Inspector and Superintendent taken together and (ii) 50% of the officers in descending order based on their longest gap from last customs posting, who have previous experience of working in Customs.’
Para 9 : The following may be added in Para 9 so as to make Customs Transfer policy in tune with the CGST Transfer policy so as to allow cooling off period in respect of the officers due for repatriation to CGST :
“f) No application for deputation/loan basis shall be considered during last year of Customs tenure.”
Itis requested that before holding Annual General Transfers 2020, the transfer policy may kindly be amended considering our suggestions and a virtual meeting may kindly be held with us before finalizing the transfer policy/holding of AGT 2020
